Terms of Service

1. Acceptance of Terms

By accessing or using trekkerheck.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Products — Lightroom Presets

All digital products, including Lightroom preset packs, are sold as-is. Due to the digital nature of these products, all sales are final and no refunds will be issued once a download has been delivered, except where required by applicable law.

Upon purchase, you receive a non-exclusive, non-transferable license to use the presets on your own photos for personal or commercial use. You may not resell, redistribute, or share preset files with others.

3. Coaching Services

Coaching packages are personal services delivered by appointment. Cancellations made with less than 24 hours’ notice may not be eligible for rescheduling. Specific terms for coaching engagements will be outlined in your coaching agreement.

4. Intellectual Property

All content on this Site — including text, photography, graphics, preset files, and course materials — is owned by Trekker Heck Photography or used with permission. You may not reproduce, distribute, or create derivative works without express written permission.

5. User Conduct

You agree not to use this Site to:

  • Violate any applicable laws or regulations

  • Infringe the intellectual property rights of THP or any third party

  • Transmit spam or unsolicited communications

  • Attempt to gain unauthorized access to any portion of the Site

6. Limitation of Liability

Trekker Heck Photography shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or its products and services, even if advised of the possibility of such damages. Our total liability in any matter arising from these Terms shall not exceed the amount you paid for the specific product or service at issue.

7. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available.” THP makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content or product.

8. Governing Law

These Terms shall be governed by the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Lane County, Oregon.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes your acceptance.
